For any fashion brand, a proportionate and realistic approach to anti-bribery procedures should form part of any policy review to ensure compliance with a complex area of criminal law. 

While one form of bribery requires proof that the recipient improperly performed his or her relevant functions in exchange for an "advantage" (financial or otherwise), that is not the end of the matter. There is a category of persons in relation to whom the simple receipt of a reward in and of itself could amount to an offence, without the prosecution having to also show that they acted in a way which was influenced by the reward. Examples of these "persons" include customs officials or health and safety inspectors.
